General Terms and Conditions
Cresta Palace Celerina AG (Cresta Palace Hotel), 7505 Celerina, is pleased to organise your relaxing stay. To ensure a successful arrangement, we kindly ask you to carefully read the following terms and conditions, which form an integral part of the contract. Thank you for your understanding and acknowledgement.

Conclusion of Contract

The provisions of the Swiss Code of Obligations apply to the conclusion of the contract. As a rule, the contract is concluded upon confirmation of the reservation or the guest’s unconditional acceptance of a hotel offer.

The customer’s general terms and conditions shall only apply if expressly agreed upon in writing in advance.

If the guest requests services that are not provided directly by the hotel, the hotel acts solely as an intermediary. These services will be billed separately.

Prices, Deposit, Invoicing

The prices are based on the concluded contract (reservation confirmation) and are stated in Swiss francs.

Unless otherwise agreed, prices include breakfast and tourist taxes.

To guarantee the reservation, a prepayment of 30% of the package price is required by credit card. The reservation is only considered confirmed upon receipt of payment. If a deposit is agreed, it must be paid within the specified period; otherwise, the hotel reserves the right to freely dispose of the rooms.

Unless otherwise agreed, the invoice must be settled by the guest at the latest upon departure. The hotel accepts cash, credit cards (Mastercard, VISA, American Express) and debit cards (Maestro, V-Pay, Postcard).

Hotel invoices without a due date are payable within 10 days of issuance without deduction. The hotel is entitled to invoice accrued claims at any time and demand immediate payment. In the event of late payment, statutory default interest of 5% of the invoice amount may be charged. The hotel reserves the right to claim higher damages.

The agreed prices include the applicable statutory VAT and taxes. The hotel reserves the right to adjust prices in the event of changes to statutory tax rates.

Cancellation Policy

Cancellation by the Guest
-
If a guest claims the reserved rooms later than agreed, does not claim them at all, or leaves early, the following cancellation conditions apply for the winter season:

up to 7 days before arrival: no cancellation fee

from 6 days before arrival: 100% of the package price
-
For the high season (end of January – beginning of March), the following special conditions apply:

up to 21 days before arrival: no cancellation fee
-
from 20 days before arrival: 100% of the package price
-
Exceptions apply for special cancellation conditions stated in written confirmations, e.g. Christmas / New Year.

During the summer season:

up to 4 days before arrival: no cancellation fee
-
3 days or less before arrival: 100% of the package price
-
The date of receipt of the cancellation by the hotel is decisive.

Cresta Palace Hotel reserves the right to adjust cancellation conditions individually depending on the scope of the booking; this will be stated in the confirmation (contract). Any change or waiver of cancellation deadlines by the guest requires the hotel’s written consent.

Income from re-letting the cancelled rooms will be credited against cancellation charges.

Cancellation by the Hotel

Rooms may only be used for accommodation purposes. The hotel is entitled to terminate the contract without notice if it was concluded based on false or misleading information or if the room is not used in accordance with the contract.

If an agreed prepayment is not made even after expiry of a reasonable grace period set by the hotel, the hotel is entitled to withdraw from the contract.

Furthermore, the hotel may withdraw from the contract for objectively justified reasons, for example if force majeure or other circumstances beyond the hotel’s control make fulfilment impossible, or if the hotel has justified reason to believe that use of the hotel services could endanger smooth operations, security or the hotel itself.

In the event of justified withdrawal by the hotel, the guest has no claim to compensation.

If the hotel is unable to fulfil its obligations due to overbooking, it shall offer the guest equivalent accommodation in another hotel.

Guest Rooms
Arrival / Departure Times
Rooms are available from 3:00 p.m. on the day of arrival and until 11:00 a.m. on the day of departure. Early arrival or late departure may be arranged in consultation with the hotel. If the room is used longer without prior agreement, the hotel may charge 50% of the listed room rate until 6:00 p.m., and 100% after 6:00 p.m.

Hotel Liability

The hotel is liable for guests’ property in accordance with statutory provisions. Liability for slight negligence is expressly excluded.

Cresta Palace Hotel assumes no liability for services provided by subcontractors within the hotel.

If the guest suffers damage or is dissatisfied with the hotel’s services, this must be reported immediately; otherwise, no claims may be asserted.

All claims against the hotel generally become time-barred six months after departure, unless mandatory statutory provisions provide longer periods.

Final Provisions

Amendments or additions to the contract or reservation confirmation should, where possible, be made in writing. Unilateral amendments are invalid.

By confirming a reservation or unilaterally confirming a booking, the customer accepts these General Terms and Conditions.

This contract is governed exclusively by Swiss law.
-
The exclusive place of jurisdiction is agreed to be Celerina / St. Moritz, Switzerland.
